These Terms of Service govern your use of the website and online booking platform operated by Everything Film Equipment Inc., doing business as Everything Film Equipment ("EFE", "we", "us", or "our"), at everythingfilmequipment.com and rent.everythingfilmequipment.com (the "Site").
These Terms of Service are separate from, and do not vary, limit, or add to, EFE's Equipment Rental Agreement. Where you book or rent Equipment from EFE, that rental is governed by the Rental Agreement you accept separately — by selecting "I agree, submit order" at checkout, or by signing at pickup. Where a matter is addressed both here and in the Rental Agreement — including liability for Equipment, damage, loss, insurance, deposits, or payment for a rental — the Rental Agreement governs. These Terms of Service govern your use of the Site itself: creating and maintaining an account, browsing and booking through the Site, any content you submit to it, and your general conduct in using it.
By creating an account, accessing, or using the Site, you agree to be bound by these Terms of Service. If you do not agree, do not use the Site.
These Terms of Service and the Rental Agreement are both part of your relationship with EFE, but they cover different things and neither overrides the other. These Terms of Service govern your use of the Site. The Rental Agreement governs each rental transaction, including EFE's and your liability in connection with the Equipment. Where these Terms of Service and the Rental Agreement both speak to the same matter and their terms differ, the document that specifically governs that matter controls: the Rental Agreement for anything concerning a rental of Equipment, these Terms of Service for anything concerning use of the Site itself.
You accept these Terms of Service by creating an account, or by accessing or using the Site, whichever happens first. If you accept these Terms of Service on behalf of a company or other organization, you confirm that you have authority to bind that organization, and "you" then refers to that organization.
You must be at least 19 years of age — the age of majority in British Columbia — to create an account or use the Site. If you are renting Equipment as an individual under 19, an adult must enter into the Rental Agreement as the Renter, or provide a guarantee and indemnity, as described in the Rental Agreement.
You may book Equipment through the Site either as a registered account holder or as a guest, where that option is available. Where you create an account, you agree to provide accurate, current, and complete information, and to keep it that way. You are responsible for safeguarding your account credentials and for all activity under your account. Notify EFE immediately at the contact information on the Site if you suspect unauthorized use of your account.
If you create an account on behalf of an employer or other organization, that organization is the account holder, and you represent that you are authorized to act on its behalf.
Through the Site, EFE lets you browse its equipment inventory, request quotes, book rentals, and manage your rental history and account information. EFE may add, change, or discontinue features of the Site at any time. EFE does not guarantee that any specific item of Equipment shown on the Site is available — availability is confirmed only when EFE confirms your order, as described in the Rental Agreement.
Prices shown on the Site are in Canadian dollars and are exclusive of applicable taxes unless stated otherwise. Payment for a rental is processed through EFE's booking and payment platform. Charges related to a specific rental — including rental fees, deposits, damage charges, and late fees — are governed by the Rental Agreement, not by these Terms of Service.
EFE may correct a pricing or availability error on the Site at any time before an order is confirmed, as described in the Rental Agreement.
You agree not to, in connection with the Site:
EFE may suspend or terminate your access to the Site if you breach this section, as described in Section 15.
If the Site allows you to submit content — such as a review, comment, or message — you are solely responsible for what you submit. You represent that anything you submit is accurate, is not defamatory or unlawful, and does not infringe another person's rights. You grant EFE a non-exclusive, royalty-free licence to display, reproduce, and distribute content you submit to the Site in connection with operating and promoting the Site. EFE may remove content at its discretion and is not obligated to monitor submissions.
If you send EFE feedback or suggestions about the Site, EFE may use them without any obligation to you.
All text, graphics, design, and other content on the Site (excluding content you submit under Section 8) is owned by EFE or its licensors and is protected by copyright and trademark law. "Everything Film Equipment" and EFE's logos are trademarks of EFE. You may not copy, reproduce, or use any of this content, or EFE's trademarks, without EFE's prior written consent.
The Site may link to, or use, third-party services — including its booking and payment platform. EFE does not control and is not responsible for the content, policies, or practices of any third-party service. Your use of a third-party service is governed by that service's own terms.
EFE's collection, use, and disclosure of your personal information is described in EFE's Privacy Policy, available on the Site. By using the Site, you acknowledge that you have had the opportunity to review it.
This section concerns the Site itself, not the Equipment; warranties and disclaimers concerning the Equipment are addressed in the Rental Agreement. The Site is provided "as is." EFE does not warrant that the Site will be uninterrupted, secure, or error-free. Nothing in this section limits any right or remedy you have under the Business Practices and Consumer Protection Act or other applicable consumer protection legislation that cannot lawfully be limited or excluded.
This section concerns claims arising from your use of the Site; EFE's liability, and your liability, in connection with a rental of Equipment is addressed exclusively in the Rental Agreement. To the extent permitted by law, EFE is not liable for any indirect, incidental, or consequential loss arising from your use of, or inability to use, the Site. EFE's total liability arising from your use of the Site is limited to the greater of CAD $100 or the fees you paid to EFE for use of the Site itself in the 12 months before the claim arose (which excludes rental charges, which are governed by the Rental Agreement). Nothing in this section limits any right or remedy you have under the Business Practices and Consumer Protection Act or other applicable consumer protection legislation that cannot lawfully be limited or excluded.
You agree to indemnify and hold harmless EFE and its directors, officers, and employees from any claim arising from your breach of these Terms of Service or your misuse of the Site, except to the extent caused by EFE's own negligence or wilful misconduct. This does not affect any obligation you have under the Rental Agreement, which is addressed there.
You may close your account at any time by contacting EFE. EFE may suspend or terminate your access to the Site, with notice where reasonably practicable, if you breach these Terms of Service. Closing or losing access to your account does not affect any rental in progress, which continues to be governed by the Rental Agreement.
These Terms of Service are governed by the laws of the Province of British Columbia and the laws of Canada applicable in it. Any dispute arising from these Terms of Service or your use of the Site is subject to the exclusive jurisdiction of the courts and tribunals of British Columbia, including the Civil Resolution Tribunal for claims within its jurisdiction.
If any provision of these Terms of Service is found unenforceable, it is severed and the remainder continues in full force. EFE's delay in enforcing a provision is not a waiver of it. You may not assign these Terms of Service without EFE's consent; EFE may assign them in connection with a merger, acquisition, or sale of assets. These Terms of Service, together with the Rental Agreement for any rental you enter into, are the entire agreement between you and EFE with respect to their subject matter.
EFE may update these Terms of Service from time to time by posting the updated version on the Site. Changes apply prospectively from the date posted and do not apply retroactively to a rental already accepted under the Rental Agreement. Your continued use of the Site after a change takes effect means you accept the updated Terms of Service.
